EstimateLock is a tool that helps service professionals send time-limited estimates to customers. We provide the software. We are not a party to any transaction, agreement, or dispute between you and your customers. Use of this service means you accept these Terms.
1. Who Can Use This
You must be at least 18 years old and use the service for lawful purposes only. You are responsible for everything that happens under your account. We may refuse or terminate service to anyone at any time for any reason.
2. What We Provide
We provide software on an as-is and as-available basis. We do not guarantee uptime, accuracy, or fitness for any particular purpose. We do not guarantee that any estimate or acceptance made through our platform is legally enforceable in any jurisdiction. EstimateLock is not a legal contract platform. Submission or acceptance of an estimate through this platform does not constitute a legally binding contract between you and your customer. You are solely responsible for your own agreements with your customers. We do not guarantee customer acceptance, job conversion, or any specific business outcome from using the service. Your use of the service is entirely at your own risk.
3. Electronic Records
When a customer accepts an estimate through EstimateLock, we may record their name, email, IP address, timestamp, and device information as part of the acceptance record.
4. Your Account
Keep your credentials secure. You are responsible for all activity under your account. We may suspend or terminate any account at any time for any reason with or without notice.
5. Acceptable Use
You may not use EstimateLock to send false or deceptive estimates; impersonate any person or business; conduct or facilitate illegal activity; send spam; violate anyone’s privacy or intellectual property rights; use automated tools to interact with the platform at non-human speed or volume; or do anything that damages, disrupts, or places unreasonable load on the service.
6. Our Intellectual Property
Everything about EstimateLock — its name, logo, code, design, user interface, architecture, workflows, and business logic — belongs to SMBData LLC and is protected by copyright, trademark, and trade secret law. Using the service gives you no rights to any of it beyond the right to use the service itself. You may not copy, reverse engineer, decompile, scrape, recreate, or build derivative works from any part of our platform. You may not use the platform or any information obtained from it to build, train, or improve any competing product or artificial intelligence model.
7. Your Content
You own the estimates and customer data you create. You give us a limited license to store and process that data to run the service. We may use aggregated anonymous data for any lawful purpose including improving the product.
8. Payments
Plans: Free (10 estimates per month), Pro ($29 per month up to 150 estimates), Business ($49 per month unlimited subject to fair use). Payments are processed by a third party. We never see your card number. Subscriptions renew automatically. No refunds for partial periods. We may change pricing at any time. We may notify existing paid subscribers as a courtesy. Continued use after a price change constitutes acceptance.
9. Fair Use
Unlimited on Business plans means unlimited legitimate human-created estimates for your own business. Automated or abusive use is prohibited regardless of plan. We determine what constitutes fair use at our sole discretion and may limit or terminate accounts accordingly without notice or refund.
10. No Warranties
WE MAKE NO WARRANTIES OF ANY KIND. THE SERVICE IS PROVIDED AS IS. WE DISCLAIM ALL WARRANTIES EXPRESS OR IMPLIED INCLUDING MERCHANTABILITY FITNESS FOR A PURPOSE AND NON-INFRINGEMENT.
11. Limitation of Liability
WE ARE NOT LIABLE FOR ANY INDIRECT INCIDENTAL SPECIAL CONSEQUENTIAL OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE GREATER OF WHAT YOU PAID US IN THE PRIOR 30 DAYS OR $100. FREE USERS AGREE OUR LIABILITY IS $0.
12. Indemnification
You agree to defend and hold harmless SMBData LLC and its team from any claims arising from your use of the service, your content, your customer relationships, or your violation of these Terms.
13. Disputes
Any dispute must be resolved by binding arbitration in Dallas County, Texas under AAA Commercial Rules. No jury trials. No class actions. You and SMBData LLC each waive the right to participate in any class or representative proceeding. For claims under $500 either party may alternatively bring an action in small claims court in Dallas County Texas. Emergency injunctive relief may be sought in court at any time.
14. Bots and Automated Access
Search engine crawlers may index public marketing pages only in compliance with our robots.txt. AI training crawlers, scrapers, and data harvesters are prohibited from accessing any part of the service. Any automated access to authenticated pages or user data is prohibited. We reserve the right to block any automated access at any time for any reason.
15. Governing Law
Texas law governs these Terms. Any proceedings not subject to arbitration shall be brought exclusively in Dallas County, Texas.
16. Changes
We may update these Terms at any time. We may provide notice of material changes at our discretion. Continued use constitutes acceptance regardless of whether notice was received.
17. Entire Agreement
These Terms plus our Privacy Policy, Cookie Policy, and Acceptable Use Policy are the complete agreement between us. If any part is found unenforceable the rest remains in effect.
18. Calculation Tools
EstimateLock provides free trade calculators (roofing square calculator, HVAC BTU calculator, voltage drop calculator, and similar tools) as informational references only. These tools use simplified models and standard assumptions. They do not account for all site-specific conditions, local code variations, material grades, or other factors that a licensed professional would consider. SMBData LLC makes no warranty as to the accuracy, completeness, or fitness for any purpose of these calculator results. You agree that SMBData LLC is not liable for any loss, damage, or claim arising from reliance on calculator outputs. Always verify results with a licensed contractor, engineer, or electrician before making purchasing or project decisions.
